All purchases are subject to acceptance of the following terms and conditions.
Trade Only. All products and product information available on this website are intended for qualified or training professional hairdressers, beauty therapists and nail technicians only and are for sale on a strictly business to business basis. Customers should be competent in using the products sold on this website. Direct Salon Supplies & Equipment (DSSE) will not be held responsible for any injury or damages in unqualified users of our products. We reserve the right to ask for proof of professional status, and refuse the order if we believe the person not to be a trade customer. As a business user, it is your responsibility to ensure that you are insured for products that you are using. Products on this site are not for sale to members of the general public.
Please read the terms and condition carefully and do not hesitate to contact us if you require further information or clarification. If you do not accept these terms and conditions, please discontinue your purchase.
This website is made available by us, United Direct Pty Ltd (DSSE) and all references to ‘we’ and ‘us’ are to Direct Salon Supplies & Equipment. All visitors to our website are referred to as ‘you’.
1. The Contract between us
To make a purchase from our website, you must complete the on-line registration form.
A binding contract for the sale and purchase of goods between you and us will only come into effect when we issue to you confirmation of order and an order reference number to the e-mail address provided by you on the registration form. We are not obliged to accept any order(s) you submit.
2. Price and payment
We reserve the right to revise at any time the price of goods offered for sale on our website without notice. All orders for goods are subject to availability and DSSE reserves the right to refuse to supply to any individual or company for whatever reason.
Although DSSE tries to ensure that prices on this website are accurate, errors can sometimes occur. The prices as stated are therefore, indicative only but an accurate total price, including delivery charges, will be confirmed to you when we send you confirmation of our acceptance of your order.) If the price when confirmed, is not to your satisfaction you reserve the right to withdraw from the purchase.
All prices are inclusive of GST (10%) and are quoted in Australian dollar.
Payment in full is required to be made prior to the dispatch of goods. We accept Visa, Mastercard, Amex, Cash and Direct Deposit as our payment methods. We do not accept cheques or paypal.
When a deposit payment has been made by credit card for any backorders, you automatically authorise DSE to take the balance due once the order arrives to our warehouse. DSE can stock your order here for up to 4 weeks free of charge but we do require full payment.
We try to deliver the goods in accordance with the delivery times and charges set out below. Please note the delivery times stated below are indicative only and we are not responsible for any delays. Neither DSSE or their designated carrier will accept claims for consequential loss due to late deliveries.
3a. Delivery times and delivery charges
We aim to dispatch your order as quickly as possible and orders for stock items will normally be processed and dispatched between 1 to 2 working days from order, depending on the items ordered. Deliveries can take up to 1-7 days depending on your location. Extra charges are applicable for furniture and bulky items.
We reserve the right to charge a re-delivery fee if you are not available to accept or receive the goods when delivered to you. A re-delivery fee of $25 will be automatically charged from your credit card supplied to us at time of order. Please note any backorder items not delivered to you will be shipped as soon as they become available. There will be no additional charge for this delivery.
3b. Furniture Deliveries
Goods will be sent by our nominated carrier service. Delivery charges vary according to location and goods ordered; this will be confirmed after the receipt of the order. We will contact you with further details when your order has been placed. As we have to rely on carriers etc, no deliveries can be guaranteed, although every effort will be made to carry out the delivery on the stated day.
4. Tax and other charges
We charge 10% GST on all orders.
5. Returns and refunds
It is your responsibility to inspect the goods immediately upon receipt and contact us in writing at [email protected]. You have the right to reject delivery of any goods that may not be deemed acceptable.
If you believe you have received damaged or incorrect goods, you must contact us by e-mail within seven days of your receipt of the goods and provide us with your order reference number. We will have the goods returned to us and pay the costs of the return shipping. If we do not receive notification within seven days, any shortage, damage or other deficiency will be deemed to have occurred after delivery to you.
If, in our opinion, the returned goods are damaged we will provide you, at our option, with replacement goods or a refund for the total costs of the goods within 7 days of our receipt of the returned goods provided you have complied with the provisions above.
If we find that the goods are not damaged or faulty, we will return the ordered goods to you and you will be responsible for the cost of the return shipping. We will also charge you an administration fee of 10% of the cost of your original order.
If you wish to return unwanted goods, please ensure that any product you have bought is in original condition, unworn or unused and sent back to us with its original packaging.
Refunds will be subject to the purchase price less a 20% handling charge. Carrier charges will NOT be refunded.
Returned goods will only be accepted where a returns authorisation has been given. The relevant reference number must be quoted on accompanying documentation. For your own protection, please obtain a receipt from the carrier, as the company accept no responsibility for lost parcels.
Goods which are given free, as part of an offer, are not exchangeable or refundable unless the full offer is returned, subject to normal terms and conditions.
Special or customised items cannot be returned or refunded unless deemed faulty.
Please allow up to 7 days for administration for any returned goods.
DSSE advises all customers to make sure they order carefully as there will strictly be no refund once order has been placed and paid for. Again, only when authorisation is approved by management will a refund be accepted minus a 20% handling charge from the total order placed.
6. Product descriptions
In describing the Products available on our website we attempt to be as accurate as possible. DSSE, however, does not warrant that Products descriptions or other content of this website is accurate, complete, reliable or error-free.
7. Your account
If you use our website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account and all passwords. To place an order on this website, you must be a trading entity (or a professional beauty therapist or hairdresser) (over the age of 16 years) otherwise you are not entitled to complete the on-line registration form required to place an order. We reserve the right to refuse service, terminate accounts or cancel orders at our sole discretion. We will deliver the goods ordered by you to the address given by you for delivery on the on-line registration form at the time of your order and by whatever means we reasonably consider appropriate.
8. User Behaviour
You may not use any of our Sites for any of the following purposes:
1. disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material
2. transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice
3. gaining unauthorised access to other computer systems
4. interfering with any other person’s use or enjoyment of our website
5. breaching any laws concerning the use of public telecommunications networks
6. interfering or disrupting networks or websites connected to the Salon Supplies Site
7. making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner
9. Ownership of Goods
We will retain ownership of the goods you order until we receive full payment for the order including the applicable delivery charges (including any charges for re-delivery in accordance with Clause 3 above). Once the goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
10. Cancellation and variation of orders
DSSE does not accept cancellations on any order. Cancellations will be subject to the purchase price less a 20% handling charge but only if authorisation has been given due to special circumstances.
11. Product availability
All products are subject to stock availability. If we have insufficient stock to deliver the goods ordered by you we may, at our option, send a carefully selected substitute, alternatively, any sum debited to your credit card will be re-credited to your account and we will notify you by e-mail at the address given by you or by phone. The refund will be made as soon as possible after such notification and in any event within 7 days of receipt of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
DIRECT SALON EQUIPMENT PROVIDES THIS WARRANTY TO THE ORIGINAL PURCHASER FROM THE DATE OF DELIVERY. TERMS AND CONDITIONS ARE AS FOLLOWS:
All products sold on this web-site are intended for use by professional hairdressers and beauty therapists only and not for use by members of the general public except under the direct supervision of a trained professional beauty therapist and/or hairdresser and DSSE and the hosts of this website accept no responsibility for and exclude any and all liability in connection with the use or misuse of any products purchased on this website.
5 YEAR STRUCTURAL WARRANTY
a. Steel structural frame elements are warranted against breakage for a period of (5) years.
b. Timber frames and steel insert frames are also warranted against breakage for a period of (5) years.
5 YEAR WARRANTY OF FOAM
c. Seat and back inserts including foam inserts are warranted for a period of (5) years. Loss of foam resiliency should not be confused with softening of foam or stretched covers, which may result from normal use. Owners of upholstered furniture should also expect foam to compact over time.
2 YEAR WARRANTY OF UPHOLSTERY
d. Our upholstery is warranted against tearing and cracking for a period of (2) years, against seam slippage, fraying and dye transfers.
The warranty does not cover tears, flattening of nap, pilling, fading or shrinkage and is not valid when heavy soiling or abuse is evident.
The warranty does not cover normal fading, damage due to improper use, damage from lack of required caution and/or regular care and maintenance.
The warranty does not include stretching of fabric. This is normal and results from normal use. Exposure of fabric to direct sunlight or extreme light sources will cause fading and damage and is not covered by the warranty.
Direct Salon Equipment assumes no warranty obligations for defects arising from normal wear and tear, accidents, acts of God, negligence, misuse, abuse, shipping/handling or alteration of the products.
1 YEAR WARRANTY MECHANISM / HYDRAULIC PUMPS
e. Recliner mechanism’s including steel springs are warranted against breakage for a period of (1) year. Please note that this does not cover any type of minor sound or noise in the mechanism or unevenness in swivel mechanisms. This is normal and the result of general use.
f. Hydraulic pumps are warranted for a period of (1) year.
1 YEAR WARRANTY ELECTRICAL
g. Warranty period for defects of new motors and related parts are (1) year.
Proper cleaning and making sure all fasteners are tightened must be performed regularly. Check and tighten all bolts, screws and knobs every (4) months on salon chairs.
Regular dusting with a damp, clean cloth and the use of appropriate cleaning and protection products performed every (4) months.
Soiled areas of upholstery should immediately be cleaned with appropriate cleaners. Do not use any cleaners that contain kerosene, silicon and/or solvents.
TO MAKE A CLAIM
Claims under this warranty will require dated proof of purchase, the product tracking number and receipt of the registered warranty, plus photographic images to support the claim. The claim should be made promptly following the discovery of any alleged defect.
Transportation to and from the retailer is the responsibility of the purchaser, including loss of time and packing.
OTHER THAN AS EXPRESSLY SET OUT IN THESE CONDITIONS, DSSE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS WEBSITE OR THE INFORMATION, CONTENT, MATERIALS OR PRODUCTS INCLUDED OR SUPPLIED ON THIS WEBSITE. DSSE AND THE HOSTS OF THIS WEBSITE, THEREFORE, EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED TO THE EXTENT PERMITTED BY LAW INCLUDING BUT NO LIMITED TO WARRANTIES OF SATISFACTORY QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT OF THIS SERVICE, OUR PRODUCTS OR ANY MATERIALS.
EXCEPT IN RESPECT OF PERSONAL INJURY ARISING FROM NEGLIGENCE, DSSE AND THE HOSTS OF THIS WEBSITE HEREBY EXCLUDE LIABILITY FOR ANY CLAIMS, LOSSES, DEMANDS OR DAMAGES OF ANY KIND WHATSOEVER WITH RESPECT OF ANY INFORMATION AND/OR SERVICES AND/OR PRODUCTS PROVIDED ON OR THROUGH THE WEBSITE INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL LOSS OR DAMAGES, COMPENSATORY DAMAGES OR LOSS OF PROFITS OR DATA WHETHER BASED ON A BREACH OF CONTRACT OR WARRANTY, DEFICIT OR TORT (INCLUDING NEGLIGENCE) PRODUCT LIABILITY OR OTHERWISE.
14. Force Majeure
Neither party shall be liable in damages or have the right to terminate this Agreement for any delay or default in performing hereunder if such delay or default is caused by conditions beyond its control including, but not limited to Acts of God, Government restrictions (including the denial or cancellation of any export or other necessary license), wars, insurrections and/or any other cause beyond the reasonable control of the party whose performance is affected.
15. Intellectual Property Rights
The content of the DSSE site is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of the DSSE site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the DSSE site without written permission from DSSE.
We reserve the right to terminate immediately your ability to use any of our internet services at any time.
These terms and conditions of purchase constitute the entire agreement between us and you relating to the purchase of our products and supersedes all other agreements or understandings between us and you.
Failure or neglect on our part to enforce at any time any of the provisions in these terms and conditions shall not be construed nor shall be deemed to be a waiver of our rights hereunder nor in any way effect the validity of the whole or any part of these terms and conditions nor prejudice our rights to take subsequent action.
If any provision in these terms and conditions is deemed to be illegal or unenforceable by any competent authority such terms and conditions shall to that extent be severed from the rest of the provision of these terms and conditions which will remain in full force and effect. We will not be liable for any failure or delay in performing our obligations due to circumstances beyond its reasonable control.
